ATTENTION CHAPTER 13 CLIENTS
Court Approval Required for sale of property or financing. Effective immediately, the U. S. Bankruptcy Court requires every person in a chapter 13 case to obtain court approval before you sell, refinance or place a second mortgage on your home. Additionally, court approval is required when you intend to purchase any item with a sale price of at least $5,000.00. The approval of the chapter 13 trustee alone is no longer required.
If you intend to sell or place financing against your home, please call my office immediately so that you can receive guidance on how to proceed. If you intend to purchase an automobile, please call me in advance. We will promptly advise you on what steps are needed to proceed with your transaction quickly and file the appropriate papers with the court to obtain approval. Remember, failure to obtain court approval in advance may result in the dismissal of your chapter 13 case and deny you of the bankruptcy relief that you sought when you filed your case.
How to Access Your Chapter 13 Case Information on the Internet . All chapter 13 clients may now access their case through the www.13datacenter.com website. This is a free service that allows you to view your case online. Most questions concerning payments received and payments to creditors are answered at this website. Proceed to the website and go to "New User" to obtain a username and password. You will need to provide the following information to get started: your name exactly as it appears on your bankruptcy petition, your seven digit bankruptcy case number and your social security number. Once you have gain access to the website, follow the on-screen prompts to review your case information. Call our office if you need help.
